Welcome to TherapyKind.com ("TherapyKind," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

TherapyKind.com is an online directory designed to help individuals find and connect with licensed mental health professionals ("Therapists") for in-person therapy sessions within the United States. The Service allows you to search for Therapists based on location, specialty, and other criteria.

IMPORTANT: TherapyKind Is Not a Healthcare Provider

• We do not provide medical advice, diagnosis, or treatment. The content and information on our Service, including therapist profiles and articles, are for informational purposes only. This information is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or another qualified health provider with any questions you may have regarding a medical condition.

• No therapist-patient relationship is created by using our Service. Using TherapyKind.com to find a Therapist does not establish a professional or confidential relationship between you and TherapyKind, or between you and any Therapist. A therapeutic relationship is only formed after you have independently contacted a Therapist and you have both formally agreed to work together.

2. THIS SERVICE IS NOT FOR EMERGENCIES

If you are experiencing a medical or mental health emergency, or if you are contemplating suicide or harm to yourself or others, you must call 911 or go to the nearest emergency room immediately.

Our Service is not designed for crisis situations. You can also contact the National Suicide Prevention Lifeline at 988 or 1-800-273-TALK (8255) for immediate support.

3. User Responsibilities and Eligibility

• Eligibility: You must be at least 18 years of age to use our Service. By using the Service, you represent and warrant that you meet this requirement.

• Permitted Use: If you are seeking therapy, the Service is intended for your personal, non-commercial use. If you are a licensed mental health professional, you may also use the Service to create, claim, and manage your own professional listing as described in Sections 5 and 6. Any other commercial use of the Service is prohibited.

• Verifying Therapists: While we make efforts to ensure the information in our directory is accurate, we do not employ the Therapists listed and do not guarantee their credentials, qualifications, or the quality of their services. You are solely responsible for verifying a Therapist's licensure, credentials, and suitability for your needs. We encourage you to check with the relevant state licensing board to confirm a Therapist's status.

4. Prohibited Conduct

You agree not to use the Service to:

• Violate any local, state, national, or international law.

• Impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity — including claiming a Therapist listing that is not your own.

• Scrape, collect, or harvest data from the Service for any commercial purpose without our express written permission.

• Interfere with or disrupt the security or functionality of the Service.

• Introduce any viruses, Trojan horses, worms, or other material that is malicious or technologically harmful.

5. Therapist Listings, Unclaimed Profiles, and Removal

Our directory contains two kinds of listings: listings that a Therapist has claimed and manages directly, and unclaimed listings.

• Unclaimed Listings: TherapyKind may create unclaimed listings from publicly available professional sources — such as state licensing board records, professional directories, and practice websites — so that clients can find licensed Therapists who offer in-person care, and so those Therapists can claim and manage their own profile. Portions of unclaimed listings may be drafted with the assistance of AI tools and are reviewed before publication. An unclaimed listing does not imply any affiliation with, or endorsement of TherapyKind by, the listed Therapist.

• No Endorsement: We do not endorse, recommend, or guarantee any specific Therapist or the services they provide. Your decision to engage with a Therapist is your own, and any interaction or agreement you have with them is solely between you and the Therapist.

• Corrections and Removal: If you are a Therapist listed on TherapyKind, you may request a correction to, or complete removal of, your listing at any time — whether or not you have claimed it. Use the report option on your listing or email us at hi@therapykind.com. After we verify that the request comes from the listed Therapist (or their authorized representative), we will honor removal requests promptly, and in any case within 7 business days.

6. Therapist Accounts, Claims, and Subscriptions

This section applies to Therapists who create an account, claim a listing, or purchase a paid listing on the Service.

• Accurate Information: You agree to provide accurate, current information for your account and listing, and to keep it up to date. You are responsible for safeguarding your account credentials.

• Listing Eligibility: Listings on TherapyKind are limited to mental health professionals who (a) hold a current license that permits them to practice therapy independently, without clinical supervision, and (b) offer in-person therapy sessions. Therapists who offer both in-person and telehealth sessions qualify; telehealth-only practices do not. Claiming or purchasing a listing includes an attestation that you meet both conditions. Misrepresenting your licensure status or service model is grounds for immediate removal of your listing and termination of your account, without refund.

• Claims: When you claim an existing listing, we may review the claim before transferring control of the listing, in order to confirm that the claimant is the listed Therapist.

• Subscriptions and Billing: Paid listings are billed as subscriptions (monthly or yearly) through our payment processor. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account dashboard; cancellation stops future renewals, and refunds are governed by our Refund Policy.

• Your Content: By uploading or submitting content to your listing — including photos, biographical text, and introductory videos — you grant TherapyKind a non-exclusive, royalty-free, worldwide license to host, store, reproduce, display, and distribute that content on the Service and on TherapyKind's official channels (including the TherapyKind YouTube channel) for the purpose of operating and promoting your listing. You represent that you own or control all rights to the content you upload. You may request removal of your content at any time, and we may decline to publish or may remove content at our discretion. This license ends when the content is removed from our platforms, except for copies retained in routine backups.

7. Intellectual Property

All content on the Service, including text, graphics, logos, images, and the compilation thereof, and any software used on the site, is the property of TherapyKind or its suppliers and is protected by copyright and other intellectual property laws. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

8. Disclaimers of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THERAPYKIND EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE INFORMATION PROVIDED THROUGH THE SERVICE IS ACCURATE, RELIABLE, OR CORRECT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THERAPYKIND, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING ANY THERAPIST;
(C) ANY SERVICES PROVIDED BY OR AGREEMENTS MADE WITH A THERAPIST YOU FOUND THROUGH THE SERVICE.

10. Indemnification

You agree to indemnify, defend, and hold harmless TherapyKind and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal or state courts located in Sheridan, WY.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. We will also update the "Last Updated" date at the top of these Terms. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
